BOARD RESOLUTIONS
Portable Basketball Hoop Apparatus displayed in public view: Effective January 1st, 2004, Basketball Hoops are required to be removed from public view when not in use.
Pet Waste Rule: In addition to all other restrictions applicable to the keeping of pets, when a dog is walked or otherwise is off the Lot of its owner, the owner of the pet shall immediately pick up any excrement and properly dispose of it. Dog excrement constitutes a health hazard and owners witnessed by a Board or Committee Member in violation of this rule will be subject to a $100 fine for each incident.
Architectural Control Rules: 1. Re-Painting your home the same color as the original exterior paint color scheme is classified as maintenance and does not require a Request Form to be completed, however, a call or a note to the management company will be required to receive a control permit number. At the Feb 8, 2005 Board Meeting:- By motion Greg Gelyon/second by Frank Credendino and carried unopposed to adopt the color wheel as presented by the Committee. Motion also included to prepare 4 additional color wheels which shall be made available to homeowners for home review upon receipt of a $25 refundable deposit.
2. Architectural Request Forms are valid for a period of 6 months from date of approval. 3. Pool Contractors Motion by Greg Gelyon/seconded by Dave Gursky that all approved pool application requests will demand from the homeowner a deposit in the amount of $500 to cover expenses incurred including but not limited to: dirt or other removal from affected storm water drain and or pond; road galley cleaning of dirt/staining or other; clearing of dirt or other to access sidewalks and advertising sign removal from property. By motion Bernie Embden/second by Adam Kemp and carried unopposed that the “pool deposit” be renamed to “All Major Construction Projects Deposit” and that the amount be increased from $500 to $1,000 effective after circulating notice of change to homeowners via newsletter.
“NO” to Go-peds! Attorney General Charlie Crist says “motorized scooters can’t legally be operated on streets or sidewalks.” Motorized scooters, also widely known by the trade name Goped, resemble push scooters, except they have an engine mounted over the back wheel. The standing rider uses motorcycle-like hand controls for braking and to vary the speed which generally tops out around 20mph but can get up to 30mph or more on fancier models. The cost can range from $200 to more than $1000. Two years ago, the Legislature changed state law to exempt motorized scooters from a section of law dealing with safety requirements for motor vehicles. Lawmakers, however, didn’t exempt scooters from the definition of motor vehicles in other laws, including one that requires all vehicles operated on streets and roads to be registered. Since there’s no provision in the vehicle registration law for scooters, Crist concluded that they cannot be used on public roads. Another unchanged law bans motor vehicles from sidewalks. GoPeds which are usually operated by under-driving age children are not only illegal but are noisy and dangerous to motorists. The Owner of the property, from which any gas powered vehicle originates which is not licensed, registered or insured, will be fined $100 without a warning notice. This Resolution will come into effect after delivery of this newsletter to each home in the community. This motioned Rule was carried unopposed by all Board Directors present at the Board Meeting held May 11, 2004.
Operation of Lots
By motion Frank Credendino/seconded by Adam Kemp to adopt Resolution to activate Section 4.2 as applicable to “operation of lots generally” and not restrict the mentioned provisions under 4.2 Approval of Plans and Architectural Control Committee to solely be enforced after fire and other casualty… carried unanimously/signed by all Board of Directors.

By motion Greg Gelyon/seconded by Dave Gursky to accept aluminum equivalent Model #ALM10WOO White Solar Group alternative for mailbox option which is easily obtainable at Home Depot…carried unopposed.
Westwood Lakes Waste Management Requirements adopted at May 2005 Board Meeting By motion Frank Marino/second by Bernie Embden to adopt the following Waste Guidelines inclusive of the editing requested and that same to be effective 10 days after the next newsletter edition which will notify the homeowners …carried unopposed Garbage must be placed curbside on the day of the scheduled pickup. No garbage may be placed at street curb earlier than 6 PM of the day before the scheduled pickup. 1) Garbage containers must be placed at the street curb, not in the street. 2) All perishable garbage must be placed in tied, durable plastic bags and put in watertight metal or plastic containers with handles. 3) No loose garbage placed in metal, plastic or any container is permitted. 4) All garbage containers must have secure lids attached. 5) Garbage that is spilled or scattered will be immediately picked up by the homeowner. 6) Non-perishable garbage and or recyclables, when placed at the street curb, must be tied or secured to prevent wind dispersal. 7) At the end of the schedule garbage pick up day, all empty garbage containers must be removed and stored out of sight. 8) If, for whatever reason the garbage is not picked up on the scheduled day, and such garbage is not rescheduled for pickup the next calendar day, then all garbage and garbage containers must be removed from the curb until the next scheduled pickup. Violators are subject to $100.00 fine without warning
ARCHITECTURAL CHANGES MADE PRIOR TO APPROVAL OR UNAPPROVED EXTERIOR PROJECTS At Board of Directors Meeting September 13, 2005: Penalty Rule for Unapproved Exterior Projects executed on Lots The Board unanimously agreed that a $100 fine without warning should be assessed to lots, which identify unapproved exterior changes.
